Conditions of Use

WELCOME TO 365ASTRONOMY! THESE TERMS AND CONDITIONS APPLY TO THE USE OF THIS WEBSITE AT WWW.365ASTRONOMY.COM and all other associated websites.

BY ACCESSING THIS WEBSITE AND/OR PLACING AN ORDER, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

USING THIS WEBSITE INDICATES THAT YOU ACCEPT THESE TERMS REGARDLESS OF WHETHER OR NOT YOU CHOOSE TO REGISTER WITH US OR ORDER FROM US. IF YOU DO NOT ACCEPT THESE TERMS, PLEASE DO NOT USE THIS WEBSITE.

BREXIT ANNOUNCEMENT

Please note, the results of the Brexit referendum caused a heavy fall of the pound sterling and as such it meant lots of additional work for us during the last few months and it's still not over. Prices of all imported products have been affected, but it is impossible to change thousands of prices every week to adjust to the currency fluctuations, therefore there might be products that are still listed at old prices. If you happen to order one of those, we will contact you shortly.

Thanks for your understanding!

1. INTRODUCTION

1.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.
1.2 We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we change the order status to pending. We will send you a dispatch confirmation by email. When we dispatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order:

  1. where goods are not available;
  2. where we cannot obtain authorisation for your payment;
  3. if there has been a pricing or product description error; or
  4. if you do not meet any eligibility criteria set out in our terms and conditions or special criteria set out in category or product descriptions.

2.4 Warranty

All brand new products come with at least 1 year UK warranty or any additional warranty will be stated under the product description or description of the product category or brand.

Please also check out our returns policy. Click here: Shipping and Returns

Daystar solar observation products also come with 1 year warranty, however these can be serviced only at the factory in the USA. Unless the fault is obvious we would have to be able to test it under the Sun before returning it to the factory and then the factory also needs to check it under the sun. The above procedure might add considerable amount of servicing time depending on the weather conditions. Solar observation products of other brands might have a similar procedure, so bear this in mind when you anticipate servicing time for these products.

2.5 Ordering from outside of the United Kingdom

Our main aim is to supply customers in the United Kingdom. This means that we try to keep ourselves within our market and not advertise on other countries' markets for those brands that we have UK only dealership for.

According to the applicable law we have a responsibility to provide you with a minimum 1 year warranty (or more in the case of special manufacturers' warranties) on the territory of the United Kingdom. Accordingly, customers from outside the United Kingdom will also be covered with the same warranty only on the territory of the UK. This means that although we won't usually refuse delivery of most of our products (with some exceptions, e.g. night vision devices) to foreign countries, if you decide to buy from us, you should agree to the condition that in the case of any warranty issue, any extra delivery fees will have to be covered by yourself; we'll be able to cover delivery fees that would otherwise apply within the UK only.

Customers from outside the European Union might have to pay customs duty, processing fees, VAT and maybe other charges as well in their country according to the law in their country.

To help you with finding the appropriate Commodity Codes for export/import we have included below a link to the Trade Tariff of the UK government:

Also here are the most frequent commodity codes, related to products on our website:

3. PRICING

3.1 Our prices include VAT as we are registered for VAT.
3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.
3.3 Our prices are reviewed periodically, but we cannot promise that there will be no mistakes made ever. Therefore if you notice an unreasonably low price, we would recommend you to contact us before placing an order as if there was a mistake it is very likely that we would not be able to accept your order, even if you already paid (in which case you would be refunded in full, of course, unless you decide to pay the price difference).

IMPORTANT INFORMATION FOR CUSTOMERS FROM OUTSIDE THE EUROPEAN UNION:
We should mention that VAT applicable only for customers from inside the EU, therefore our prices for customers from outside the European Union will be reduced by the VAT throughout the checkout process. You may be liable for paying custom duty or/and VAT in your country.

4. CANCELLATION AND RETURNS POLICY

4.1 If you wish to cancel your order:

  1. you can notify us by calling us or by email to before we have dispatched the goods to you. We'll take responsibility only if we confirmed receipt of your cancellation email. If you haven't received a confirmation from us, it might mean that we haven't received your cancellation email in the first place. In this case we would advise you to call us urgently.
    or
  2. where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.

4.2 You can return goods you have ordered from us for any reason at any time within 14 days of receipt for a full refund or exchange. The delivery cost will be refunded only if you haven't received the ordered product at all (e.g. lost on delivery) or you returned the goods without using them.

According to the distant sales regulations it is your responsibility to pay the cost of returning the goods to us.

Most of the products can be opened and examined without damaging the packaging or can be sealed back into nearly as new state without problem, in which case we'll give you a full refund.

However, some products (e.g. digital cameras, ccd cameras, high value accessories, night vision devices, Minox binoculars etc) come in factory sealed secured packaging. If this packaging is broken before you changed your mind, or you tried a product and the assembly process resulted in some marks on some parts of the product, we will not be able to give you a full refund, but we will negotiate with you a reasonable cancellation/return fee for the caused damage that will allow us to sell the returned product at a discounted price.

4.3 Upon receipt of the goods and after inspection of the goods, if found in AS NEW condition, we will give you a full refund of the amount paid or an exchange credit as required (except the above cancellation/return fee if applicable).

4.4 The rights to return the goods to us for full refund as referred to in clause 4.3 will not apply in the following circumstances: -

  1. in the event that the product has been used. In this case please call us, because we may still accept it for resale as a used/second hand product, but only after negotiation of acceptable for both parties cancellation fee.
  2. to any products that we have made or customised specifically for you
  3. to any products that we don't usually stock and the product description states that it is "available on back order only". We might accept return of such goods, but only after negotiation of acceptable for both parties cancellation fee.

The provisions of this clause 4.4 do not affect your statutory rights.

Your rights to return the goods are protected under the EU Distance Selling Directive which can be found on the following website:
http://www.hmso.gov.uk/si/si2000/20002334.htm
